The Supreme Court has repeatedly held that federal courts possess inherent authority to punish contempt—i.e., disobedience of a court order or obstruction of justice—and to impose other sanctions on parties or attorneys who engage in misconduct.
Under the inherent contempt power of the House, the recalcitrant witness may be arrested and brought to trial before the bar of the House, with the offender facing possible incarceration. 3 Hinds Sec.

The inherent contempt powers have only been used once by the House in our history, in 1934, in a matter far less serious than the one that is at the center of this issue.
Rep. Luna’s actions have put the DOJ (in general) and p.o.s. Merrick (in particular) on notice. “Continue to stonewall us at your peril.” Speaker of the House Johnson is pushing for a lawsuit against p.o.s. Garland for ignoring the Congressional subpoena. DOJ is asserting that POS Biden is claiming Executive Privilege in the document issue and that the privilege extends to the language in the Hur report that’s at issue. If the Johnson lawsuit fails to force p.o.s. Garland to comply with the House’s subpoena, House members should be willing to go forward with their powers under Inherent Contempt. Weak-kneed members should borrow some cojones from Ms. Luna, or Lauren Boebert, or Elise Stefanik, or Tulsi Gabbard, et. al. Voters should be actively urging their Representatives to get on board with this initiative should it be necessary. This is without doubt a National security issue.
